Texas is the second-biggest state in the country, home to pro teams, deep pockets, and a gambling appetite to match. Yet in 2026 it remains one of the toughest places in America to place a legal bet.

There are no commercial casinosno legal sportsbooks  and no regulated online gambling within its borders. Demand is enormous and the money is real, so the only thing standing in the way is the politics.

Sports Betting: Big Push, No Payoff

Sports betting has come tantalizingly close in Texas, only to stall every single time. Back in 2023, a constitutional amendment to legalize online wagering cleared the House with 101 votes, the furthest any expansion measure has ever gotten.

The 2025 session brought another serious push, headlined by SJR 16 and HJR 137. Both died in committee, which keeps Texas sitting among the most restrictive states on the broader map of US gambling law.

The roadblock has a name: Lieutenant Governor Dan Patrick, who controls what reaches the Senate floor. As of December 2025, he said he was simply "not there yet" on casinos and betting, and a bloc of conservative House Republicans has pledged to oppose any expansion.

That resistance holds even though Governor Greg Abbott backs legalization and roughly 60% of Texans support it. Because any change requires a two-thirds vote in both chambers plus voter approval, the math stays brutal.

 

Casinos: Three Tribes And A Locked Door

Texas has no commercial casinos, and that will not change without amending the state constitution. What it does have are three tribal venues that operate under federal sovereignty rather than a state gaming law:

  • Kickapoo Lucky Eagle in Eagle Pass is the largest, with roughly 3,300 machines, a poker room, and a 249-room hotel 
  • Naskila near Livingston 
  • Speaking Rock in El Paso rounds out the trio, both running electronic bingo under Class II rules

None of these can legally offer table games like blackjack or roulette without a state compact. That limit comes from a 2022 US Supreme Court ruling, which held the state can only outlaw games it bans statewide. 

Because bingo is legal for charity, the tribes may keep running electronic bingo. It was a narrow win that steadied Naskila and Speaking Rock, without opening the door to full casino gaming. 

Bigger money keeps circling, too. Las Vegas Sands has spent three straight sessions lobbying for "destination resorts," while the Alabama-Coushatta Tribe broke ground in 2026 on an expanded Naskila resort.

New Mexico takes a quieter route, hosting retail sportsbooks tucked inside its tribal casinos rather than a full online rollout. Even so, each of these states keeps gambling dollars that Texans currently have to leave home to spend.

Nowhere is that clearer than just across the Red River, where Oklahoma's dozens of tribal casinos form one of the largest gaming markets in the country. Border venues like WinStar are built specifically to catch Texan traffic pouring up the interstate every weekend.

The same pull works in the Southeast. A similar tribal-compact framework powers Florida's fast-growing online sports betting scene, proof that one well-structured deal can unlock a market almost overnight.

For Texas, the lesson is uncomfortable but simple. The demand is already there, and right now it is being satisfied on somebody else's tax base.

Texas Gambling Is On Hold - For Now

So the biggest untapped gambling prize in America stays locked, at least for now. The demand is undeniable, the operators are lined up, and public opinion has swung firmly toward yes.
