West Virginia moved quickly after the federal sports betting restriction collapsed in 2018.

In March 2018, the state passed legislation allowing sports wagering, making it one of the earliest adopters in the U.S. even before full federal legal clarity was settled in court. When the U.S. Supreme Court decision in Murphy v. NCAA (May 2018) removed federal restrictions, West Virginia was already positioned to act.

On the other hand, Delaware's gambling framework shares similarities with West Virginia in scale and structure, but has a more limited digital casino offering and smaller operator footprint.

West Virginia’s position is therefore defined by control rather than scale - fewer operators, tighter regulation, and slower but stable expansion.

Today, online gambling in West Virginia is built around a hybrid model:
